In this Privacy Policy (“Policy”), we describe how Periapt Corp., doing business as “Pery” and its subsidiaries and affiliates (collectively, “Periapt”, “Pery”, “Company”, “we”, “our”, “us”) collects, uses, and discloses information that we obtain about visitors to our website URL (the “Site”) and the services available through our Mobile Application, as described by the Terms and Conditions of Use (collectively, the “Services”).
By visiting the Site or using any of our Services, you agree that your personal information will be handled as described in this Policy. Your use of our Site or Services, and any dispute over privacy, is subject to this Policy, our Terms and Conditions of Use including its applicable limitations on damages and the resolution of disputes. The Terms of and Conditions of Use are incorporated by reference into this Policy.
In this Policy, the terms “you” and “your” means you, as the user of the Services, or the parent or legal guardian of the user of the Services, your dependents if any, any other person accessing your User Account (as defined in the Terms and Conditions of Use), and each of your heirs, assigns, and successors. The Services are, in part, intended for the benefit of individuals under the age of eighteen (18); however, individuals under the age of eighteen (18) are prohibited from using all or any part of the Services or entering into these Terms, unless a parent or legal guardian provides written consent to use of the Services or these Terms.

We may collect your email, contact information, name, home address, billing address, shipping address, telephone number, date of birth, credit or debit card number (for payment purposes), ethnicity, family demographics, medical history, other health information, behavioral/mental health information and associated diagnoses and medications, audio records, video records (when you connect with us via video, which we may record for quality assurance purposes), documents, images and photographs you share with us, and any other information you volunteer when contacting us through the Site or mobile app. We may also ask you for information when you report a problem with our Services. We may collect certain basic information about your medical history before you create an account to become a customer. You are responsible for the accuracy of any information you provide to us. You may be required to provide financial information before using or placing an order through our Services.
Information We Collect Automatically. We automatically collect information about your use of our Site through cookies, web beacons, geolocation, and other technologies. When you use our Services, we may collect and store information about your general location by converting your IP address into a rough geo-location. We may also access your mobile device’s GPS coordinates or location, but only if you have previously agreed that we can collect this information by allowing the sharing of your location information. If you do not want us to have your location information, you agree to disable the location sharing feature on your device or browser.

Our Use of Cookies and Other Tracking Mechanisms
We and our third-party service providers use cookies and other tracking mechanisms to track information about your use of our Site or Services. We may combine this information with other personal information we collect from you (and our third-party service providers may do so on our behalf).

Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third-party websites. We are not responsible for the information practices of such third-party websites.
Security of My Personal Information

Please be aware that despite our best efforts, no data security measures can guarantee security of your data. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site or in your operating system.

We urge you to take every precaution to protect your information when you are on the Internet, or when you communicate with us and with others through the Internet. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your user account via unauthorized password activity. Retention of Information
We will retain personal information about you for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law.
What Choices Do I Have Regarding Use of My Personal Information?
We may send periodic informational emails to you. You may opt-out of promotional emails by following the opt-out instructions contained in the email. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving promotional emails, we may still send you emails about your account or any services you have requested or received from us.
As further set forth in the Terms and Conditions of Use, by providing your mobile phone number, you are agreeing to be contacted by or on behalf of Periapt at the mobile number you have provided, including through telephone calls and text messages, to receive information, product or service related messages and communications. Message and data rates may apply. To stop receiving text messages, reply to us with the word “STOP”. We may confirm your opt out by text message. Please be aware that by withdrawing your consent, some Services may no longer be available to you. If you stop receiving text messages from us, you may not receive important and helpful information and reminders about your services.
Your Rights Regarding Your Information and Accessing and Correcting Your Information
You may contact us to access or change your personal information that we have about you. You may also be able to review and change your personal information by logging into the Site through your user account. You can contact us to access or find out what information we have about you and to ensure that the information we have about you is correct, complete and current. We may not be able to accommodate your request if we believe that it would violate any law or legal requirement or cause the information to be incorrect.
Children Under 18
If you are considered a minor under the privacy laws in the United States, we must obtain your parent or guardian’s consent prior to us allowing you to access the Services. Our Services are not designed for children to use in their individual capacity without a parent/guardian. Children under the age of 18 cannot create an account with us. If we discover that an individual under the age of 18 has provided us with personal information that is not linked to the parent/guardian’s account, then we will delete such information from our systems. No personal information about a child will be made available to the public or sold. We may share information with our service providers if necessary for them to perform business, professional, or technology services for us, all in accordance with this Policy.

Note that these rights only apply to personal information we collect and process under this Policy as a business or controller. Please note that submitting an opt out request will only opt you out of disclosures that are considered “sales” or “sharing” under the CCPA, but it will not opt out of other disclosures, such as to our service providers.

Verification. Before responding to your request, we must first verify your identity using the personal information you recently provided to us. You must provide us with our name, street address, city, state, zip code and an e-mail address or phone number. We will take steps to verify your request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information in order to verify your identity, or where necessary to process your request. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for the denial.
Authorized Agent. You may designate someone as an authorized agent to submit requests and act on your behalf. Authorized agents will be required to provide proof of their authorization in their first communication with us, and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.
International Transfers
Your information may be stored on controlled servers with limited access and may be stored and processed in the United States. We offer our Services only to individuals located in the United States, and we do not advertise our Services outside of the United States. If you are located outside of the United States and choose to provide your personal information to us, please note that we may transfer your personal information to the United States or another country where our service providers are located, and such countries may not provide the same level of data protection. Those who choose to access and use the Services from outside of the United States do so on their own initiative and at their own risk.

VCDPA and Colorado Privacy Act (“CPA”) Appeals.
